Introduction

It’s a pleasure to have a community at CarMart-Ph intact and respect each user. It is vital to the online operation that users will not only have an incredibly good experience in buying and selling using our website, the “CarMart-Ph” but also users will feel comfortable and safe while doing every transaction.

This Privacy Policy supplements our “Terms & Conditions” and elaborates how CarMart-Ph handles information collected and received in the course of user utilization to our websites, mobile applications, and services (collectively, the “Services”). It also governs the collection, use, and disclosure of user's information.

Information Collection

We may collect and receive information from the user in the following situations:

  • When the user registers for an account with us (“Account”). The following will be collected from the user:
    • Picture ID (for seller)
    • Complete Name
    • Email Address
    • Phone / Cellphone number 
    • Location
    • Valid ID (for seller)
  • When users utilize the features and functions available on our Services, for example, by creating a car listing, and interacting with other users through our inquiry feature.
  • If the user contacts us, for example, with a query or to report a problem.
  • When the user interacts with us offline or through an external third party.

The user is under no obligation to provide the information to us. However, if the user chooses to withhold the information or to revoke permission for us to receive the information, we may be unable to provide certain aspects of our Services to the user.

We may collect and receive the following information. Please note that not all of our Services collect all of the information listed below:

      • Account credentials such as username.
      • Profile information such as name, gender, email address, profile photo, cellphone number. Location information such as last known location, meet-up location.
      • Any other information disclosed by you in any of the above-mentioned methods and/or through the use of our Services.
      • Aggregate data collected through the use of our Services.
      • Any communications between you and another user of our Services.

User Interactions

Our Services offer features that allow users to connect and communicate between users, and they are able to share information with each other to complete a transaction. Please use common sense and exercise good judgment when sharing information with others. We generally do not monitor or remove the information that users share and such information may remain available on our Services after the user’s Account has been banned, deactivated, terminated, or is otherwise closed. The user is responsible for the information he/she chooses to share on this platform with other users.

Purposes of information collection

We may use the information collected and received from the users for the following purposes:

  1. To verify the user’s identity, update our records, and generally maintain user Account with us.
  2. Provide our Services and customize the content shown to you.
  3. Develop, operate, improve, deliver and maintain our Services.
  4. To validate and process the transactions.
  5. To process or resolve any dispute arising from or in connection with any transactions, in accordance with our Terms & Conditions of Service.
  6. To detect or monitor any frauds or other prohibited content, businesses, or activities.   
  7. Responding to user’s queries and resolving complaints.
  8. To facilitate, confirm and/or provide updates or notifications in relation to any transactions.
  9. Carry out polls, surveys, analysis, and research on how our Services are being used and how we can improve them.
  10. To update the users on their listings and our Services (e.g. new offers, new chats, new feedback, new comments). These updates will be sent either by email and/or through push notifications.  
  11. To send the user marketing and/or promotional materials on the latest products and services of CarMart-Ph or carefully selected third parties.
  12. To send the user service-related messages including, without limitation, a welcome/confirmation email when the user registers and to enforce our Terms & Conditions of Service and other policies. These messages are not promotional in nature. These messages will be sent either by text message, email, and/or through push notifications and the user may not opt-out of receiving service-related messages from CarMart-Ph unless the user deactivates its account.
  13. To provide and carry out cross-application and cross-device advertising (i.e. Advertising across browsers and applications on a single device, as well as cross-device advertising), advertising delivery, and reporting. Information includes the information described above and data and collected from a particular computer, browser, or device and may be used with another computer, browser, or device that is linked to the computer, browser, or device on which such data was collected.
  14. To comply with applicable Anti-Money Laundering and Countering the Financing of Terrorism regulations and other applicable laws and regulations.

Information sharing  

To the extent necessary and as permitted by law, CarMart-Ph may share information about the user in the following ways:

  1. When a user registers for an Account, the information that the user provides will be available on the user’s profile and may be viewed by other users of our Services. Other users of our Services would also be able to view the content that user upload and share on our Services.
  2. We may share the information with our potential partners, investors, and other parties with a view to a potential business partnership, collaboration, joint venture, or otherwise in furtherance of our business.
  3. We may share any information collected in accordance with this Privacy Policy with (i) governmental and other regulatory authorities or the courts in any jurisdiction; (ii) any third party claimants or potential third party claimants; or (iii) your card issuing bank, financial institution and/or payment service provider, to process or resolve any chargeback, payment reversal and/or dispute arising from or in connection with a transaction using our Services in accordance with our Terms & Conditions of Service.
  4. We may disclose the user’s personal information if required to do so by law or if we believe that such action is necessary to prevent fraud or crime or to protect our Services or the rights, property, or personal safety of any person.

We respect user’s privacy and we will not sell user's personal information to any third party. We may disclose data and aggregate statistics about users of our Services and sales to prospective partners, advertisers, sponsors, and other reputable third parties in order to describe our Services, deliver targeted advertisements, or for other lawful purposes, but these data and statistics will not include information which can be used to identify the user.

User Information Protection

The security of user information is important to us. We have security measures in place to protect against the loss, misuse, and alteration of the information under our control.  However, no absolute certainty over the Internet space or method of electronic storage is 100% secure. It is important that users must protect against unauthorized access of their Account and information by choosing user passwords carefully, and keeping user passwords and Account secure (e.g. by signing out after using our Services).

Deleting, accessing, and updating user information

Users may access and update information within our Services through the “Settings” page of the user Account.

Where the user provides personal information to us, the user is responsible for providing accurate, not misleading, complete, and up-to-date information and any other person whose personal information the user provides us, and to update this personal information as and when it becomes inaccurate, misleading, incomplete or out-of-date.

In certain circumstances, the user may need to provide us personal information about someone other than him/herself. If so, we rely on the user to inform that individual about the personal information provided to CarMart-Ph, to make sure he/she consent to the user by giving us their information, and to advise them about where they can find a copy of this Privacy Policy.

If a user wishes to:

(1) apply for a copy of the information we hold about the user;

(2) withdraw consent from the user previously provided to us for use, collect or disclose the information we hold about the user.

Accessing / Updating user information: Please allow us a reasonable period of time to respond to any request and effect any change. We may ask to verify user identity and for more information about the user’s request. Where we are legally permitted to do so, we may refuse user requests and may give users reasons for doing so.

Deleting user information: Please note that, in certain circumstances, we will not be able to delete user information without also deleting the user account. We may be required to retain some of the user information after the requested deletion, to satisfy our legal or contractual rights and/or obligations. We may also be permitted by applicable laws to retain some of the user information to satisfy our legitimate business needs.

Privacy Policy changes

CarMart-Ph reserves the right to make changes to this Privacy Policy at any time and all changes will be posted here. If we believe that the changes are significant, we will notify the users of the changes by email. Users are responsible for reviewing the changes which we make to this Privacy Policy. Users continued use of our Services constitutes acceptance of the updated Privacy Policy.
